Borislav Boyanov & Co. chosen by Rosatom to advise on Belene NPP

On 14th February 2011, the Russian corporation Rosatom announced that it has chosen two law firms – Borislav Boyanov & Co. and Freshfields Bruckhaus Deringer – who are to advise on the establishment of the second nuclear power plant Belene in accordance with the EU legislation. Borislav Boyanov & Co. was selected by Rosatom among six candidates. The Firm will advise the Russian corporation on the creation of the project company for Belene NPP.

Borislav Boyanov & Co. Successfully Defends Client against Allegations of Predatory Pricing

The Bulgarian competition regulator today issued a decision rejecting the complaints of two Pay-TV operators of Sofia and Plovdiv, against Pay-TV, internet and telephony operator Blizoo Media and Broadband in respect of allegations of predatory pricing of some of their services and packages.

After reviewing the complaints on their substance, the Commission for the Protection of Competition found that the respondent in the first place is not dominant in any of the relevant markets in which it operates. As dominance itself is a prerequisite for the analysis of any abuse of dominance allegation, it held that the allegations were unfounded.

Previously, the Commission found that the services and packages also did not violate unfair competition rules against pricing below cost.

Borislav Boyanov & Co. advised Ideal Standard International on the consolidation of its Bulgarian businesses

Borislav Boyanov & Co. advised its long-standing client and world leading manufacturer of bath and kitchen products, Ideal Standard International, on the consolidation of its Bulgarian businesses. On 31 January 2011, our team, led by Yordan Naydenov (Partner) and with the active participation of Radoslav Alexandrov (Associate), successfully closed a complex merger between one of the largest Bulgarian companies Ideal Standard Bulgaria EAD and Ideal Standard – Vidima AD. The merger was implemented in extremely short time of less than 4 months. The consolidated company under the name of Ideal Standard – Vidima AD will have more than 3,000 employees and annual turnover of more than EUR 150 million.

Borislav Boyanov & Co. will continue to advise its client on all post-merger issues.

Competition authority refuses to initiate proceedings on alleged pricing below cost by food retailer

The Commission for the Protection of Competition issued information that following a preliminary investigation it intends not to initiate proceedings in respect of allegations of pricing below cost by a major food retailer in Bulgaria.

Selling of significant quantities of goods for extended periods of time below their production and marketing cost is a standalone infringement of local unfair competition law, even outside dominance.

Borislav Boyanov & Co. represented the retail chain against which the preliminary investigation was directed.

New Electronic Communications Policy

The attached article focuses on the new policy in the electronic communications sector of the Republic of Bulgaria, adopted by the Council of Ministers and announced in the beginning of this year. The policy envisages a number of measures in the sector, which will affect the activity of electronic communications operators and electronic media.
