Borislav Boyanov & Co. successfully defended its client, a major international pharmaceuticals manufacturer, who along with other pharmaceutical manufacturers stood accused of prohibited agreement or concerted practice, on a case brought by a local distribution and manufacturing company before the Commission for the Protection of Competition. The allegations were entirely dismissed by the competition authority who found that the actions of the defendants were completely legitimate and did not have as their object or effect the restriction of competition.

The adoption of the EU Takeover Directive and the subsequent passage of implementing legislation in most EU member states should have created a level playing field for the conduct of European takeovers. However, the opt-out provisions within the Directive have meant that it sets only minimum standards and consequently there are substantial variations in law between Member States.
