The Parliament passed a Law on amendment of the Telecommunications Act of 2003 (effective as of October 2, 2005). The amendments, intended to implement better the rules of Directive 2002/21/EC in the national legislation, reinforce the powers of the Commission on Regulation of the Communications (“CRC”) in respect of telecommunication operators with significant market power (“SMP”). The CRC shall be empowered, acting upon a request of an interested party and after conducting a special investigation, to intervene in the negotiations between that interested party and the respective operator and/or to give compulsory instructions to the operator. The CRC has declared the Bulgarian Telecommunication Company (BTC) as a telecommunication operator with SMP in the markets of fixed telephone networks, provision of fixed voice telephone services and of providing the service “leased lines”. Also in 2004 the GSM operator MobilTel was declared as an operator with SMP in the markets of mobile telecommunication networks and provision of voice telephone services through them. The CRC plans to make a new analysis of the mobile telecommunications markets and determine the operators with SMP later this year.
